1 Your project and order

We will prepare the landscape design deliverables identified in your itemized order for the property and areas selected. Your order records the selected services, total price, deliverable formats, agreed revision allowance, and estimated milestones. This agreement and that order describe our work. Any later change must be agreed in writing; a later website change does not alter your accepted order.

2 Core design package

The core package is $2,500 and includes remote review of available property information, a master concept, hardscape design, a coordinated planting plan, and a final digital plan package. Planting deliverables identify the selected plants and include quantities, names, and plant photographs, with additional sheets when needed. Your final plan package includes PDF plans. Editable CAD files are included only when expressly listed in your itemized order. The order will identify any other included file formats. Construction, installation, physical materials, and ongoing maintenance are not included.

3 Optional plans and enhancements

Each option is $250 and is included only when listed in your accepted itemized order, subject to the payment schedule in Section 8. Choose physical design features and technical plans before submitting the design interview so they can be coordinated from the beginning.

Available design options: Irrigation Plan; Landscape Lighting Plan; Outdoor Acoustics Plan; Pool & Spa Design Plan; Outdoor Kitchen Design Plan; Fire Feature Design Plan; Water Feature Design Plan; Gazebo, Pavilion & Pergola Plan; and Covered Outdoor TV Room Plan.

Irrigation, landscape lighting, and outdoor acoustics plans provide coordinated layouts with equipment and material recommendations, developed after hardscape and planting approval. Installation, controller programming, and any separately required engineering or permit services are not included in the $250 option fee. Any additional services and fees require separate written agreement.

Available enhancements: Day & Night Landscape Renderings, sold together for $250 total; 360° Interactive Tour; Cost & Phasing Plan; and Expanded Quantity Takeoff. These may be ordered initially or after design approval if they do not change the physical design.

Drainage and grading plans are not offered or included. We may identify visible or reported concerns that affect the design and recommend an appropriate local professional. We do not undertake drainage calculations, grading design, or site elevation design under this agreement.

Plans for pools, spas, outdoor kitchens, fire and water features, gazebos, pavilions, pergolas, and covered outdoor rooms provide creative design, placement, appearance, and material direction. Structural calculations, engineering, permit documents, and professional seals are excluded unless expressly included in your order and provided by an appropriately licensed professional. Any separately required services and fees will be disclosed before purchase.

4 How the design proceeds

First, you select the complete project scope and provide your property information, preferences, photographs, and any existing documents you have. We help you clarify choices when you are unsure. We then develop the hardscape direction for your review, followed by the planting plan. Your recorded approval of each stage establishes the design direction for the next stage.

Purchased irrigation, lighting, and outdoor acoustics plans follow hardscape and planting approval. Separate homeowner engineering interviews are not required. You may still tell us about existing equipment, watering restrictions, sensitive windows, nighttime use, or other conditions that affect the design. Technical services will be provided only within the lawful scope confirmed for your project.

We review the selected deliverables for coordination before releasing the final package. “Final” means the agreed design package has completed our review; it does not mean a permit has been issued or that every construction condition has been verified. Before delivering plans, Designscape will clearly disclose any known unresolved issues that prevent their intended use. Homeowner approval of the design does not establish that the plans are technically complete.

5 Your information and our remote service

Designscape does not visit properties. We use your information and available aerial imagery, property records, and other remote sources. These sources may be incomplete, outdated, or inaccurate and do not establish surveyed boundaries, underground utilities, footing locations, soil conditions, or water pressure. Please identify features that must remain and report known easements, restrictions, drainage concerns, or hazards. You need not guess engineering measurements or create documents you do not have.

When reliable information or local professional work is necessary, we will identify the gap and discuss how to proceed. We will not invent missing measurements. You or your chosen contractor may arrange any separately required survey, utility location, testing, or professional services. No additional charge is authorized without your approval.

6 Reviews revisions and changes

Your package includes two consolidated rounds of hardscape revisions and two of planting revisions within the agreed scope. Each purchased technical plan includes one coordination round. A round is one combined set of requested changes followed by our revised response. Corrections of our errors or failures to follow the agreed scope do not count against this allowance or require an added design fee.

Please review the layout, selections, and stated assumptions before approving a stage. Your approval confirms your preferences; it is not a waiver of our responsibility for errors and does not certify technical safety. Silence does not constitute approval.

A new feature, changed property area, or substantial redesign after an approved stage may require additional work. We will explain the price and schedule effect and obtain written approval before proceeding. Selecting a later enhancement does not authorize changing the approved physical layout.

7 Timing and communication

Your order will state estimated milestones based on the project scope and identify what is needed to begin. Timing depends on receipt of required information, scheduled payments, and homeowner approvals. Delays in these items, third-party services, or necessary professional review may affect the estimates. We will communicate material delays and provide updated estimates. This agreement does not promise a universal project turnaround, construction start date, or permit approval date. 8 Payment cancellation and refunds

Your itemized order shows the total design fee, selected options, taxes if applicable, and four scheduled payments: 25% at checkout; 25% after your recorded hardscape approval; 25% after your recorded planting approval; and the remaining balance after your final design sign-off, before release. The first three installments are each 25% of the original agreed order total. The final installment is the unpaid balance, including later enhancements you separately approve and any credits or adjustments. A core-only $2,500 order has four $625 payments. No later service or repeat charge is authorized without your separate approval.

The $2,500 core design fee is allocated as follows: property research, project setup, and preparation of the design brief, $625; hardscape design, $625; planting plan, $625; and the final coordinated plan package, $625. These amounts total the existing core fee and are not additional charges. Optional plans and enhancements are accounted for separately at their agreed prices. These stage values are used with the completed-work and cancellation terms below; payment collection alone does not make an unfinished stage or option fully earned. Final release remains subject to completion and full payment under Section 12.

You may cancel by written notice through the portal or support email. Fees allocated in your itemized order to a design stage that Designscape has completed within the agreed scope, presented for your review, and you have expressly approved are earned and nonrefundable solely because you later cancel, change your preferences, postpone construction, or decide not to build. Payment for such completed work does not authorize use or distribution of interim plans; final release remains subject to Section 12.

The initial installment is 25% of the original agreed order total. Of that payment, 25% of the core package price ($625 for the $2,500 core package) is an advance for property research, project setup, and preparation of the design brief. The remaining portion is allocated as a 25% advance toward each selected option. The core portion is earned as the initial-stage services are actually completed; option advances are earned under the optional-plan terms below, not merely when payment is collected. If no work has begun, the initial installment is refundable. If you cancel before the corresponding work is complete, Designscape will provide an itemized account of documented work completed and refund the unearned balance using the completed-work assessment described below. Fees retained for the initial core stage will not exceed its $625 allocation, and the same work will not be counted again toward a later stage or option. These allocations do not increase the agreed order total or change the four-payment schedule. Amounts collected toward unfinished stages or unperformed options are not automatically earned merely because an installment has been paid. Refunds required by applicable law and remedies for Designscape’s failure to perform as agreed are preserved.

For each optional plan or enhancement priced at $250, the fee is earned when the agreed work is completed, presented for review, and expressly approved. An earned fee is nonrefundable solely because of a later change of mind, cancellation, postponement, or decision not to build. If an option has been started but is unfinished when you cancel, Designscape may retain only the amount attributable to documented work actually completed using the completed-work assessment described below, capped at the option’s agreed price. If no work on an option has begun, advance payments allocated to it are refundable. The same work will not be counted both toward the initial installment and toward an option fee. These terms preserve refunds and remedies required by applicable law or arising from Designscape’s failure to perform as agreed.

For a stage or option that is partly completed when cancellation is received, Designscape will assess the reasonable proportion of its agreed fee earned by the work actually completed, considering the nature and extent of that work and supporting project records. The amount retained will not exceed the applicable agreed fee, and the same work will not be counted twice.

We refund payments exceeding the amount lawfully earned, including unearned portions of purchased options. Within 10 business days after receiving your cancellation request, we will provide an itemized account of completed work and initiate any refund owed. Your bank or payment provider may require additional processing time. Any shorter legally required deadline takes priority. We will not retain fees for services we cannot lawfully provide or fail to provide as agreed. Applicable cancellation and refund rights take priority.

If we cannot complete an agreed service, we will notify you and refund the unearned portion. Cancellation does not by itself authorize use of incomplete plans; applicable legal rights are preserved. If you report a defect, we will review it and propose a correction or other appropriate remedy. These provisions do not limit remedies available under applicable law.

9 Construction and professional responsibilities

This agreement is for the stated design services, not construction management, a boundary survey, permit approval, or a guarantee of site conditions. Where the project requires a licensed professional, that work must be performed by a properly authorized professional under an identified scope. We will not substitute a general disclaimer for a legal requirement or represent AI-generated documents as professionally sealed plans.

Before construction, the responsible installer and any required local professional must verify relevant dimensions, utilities, foundations, site conditions, product requirements, and necessary approvals. They must resolve discrepancies before the affected work proceeds. Homeowner approval confirms the selected design, layout, and preferences.

You choose and contract directly with installers and other professionals. Our optional contractor referral assistance is free and does not require you to hire a referred business. We obtain your approval before sharing your contact details for an introduction. We do not collect the contractor’s payment or warrant a contractor’s workmanship.

10 Estimates equipment and illustrations

Cost and phasing information is an estimate, not a contractor bid or price guarantee. Plant growth, availability, seasonal appearance, and product availability may vary. Photos and renderings illustrate selections or design intent and are not a guarantee of the completed appearance. Material or plant substitutions that materially change the approved design require your review.

Purchasing an irrigation or lighting plan does not include a connected controller account, automatic programming, monitoring, installation, or ongoing operation. Any future equipment connection requires separate confirmed availability, terms, and authorization. No controller action is authorized by this agreement alone.

11 Digital tools and project information

Designscape uses AI-assisted tools and digital workflows to develop and coordinate designs. Named digital guides and avatars are software interfaces, not representations that you are speaking with a licensed professional. Your itemized order identifies the services included in your package.

We use the information you provide to deliver and support the project, including processing by the service providers described in our separate privacy notice at https://designscape.com/privacy. This agreement does not grant permission to use your home, name, images, or plans in public advertising. Such use requires separate consent.

12 Using your plans

Designscape releases the final plan package only after all deliverables in the agreed order are complete, final review is finished, and all amounts due for that order have been paid in full. Interim previews are solely for homeowner review and approval; they are not released for contractor use, bidding, permitting, construction, or distribution. After final release, you may use the completed package for this property and share it with your contractor, suppliers, and required professionals for estimating, permitting where appropriate, construction, and maintenance. We retain any rights we hold in reusable tools, templates, and underlying materials. Third-party images and product information remain subject to their owners’ rights. We do not promise exclusive copyright ownership in AI-generated content.

These plans are for this property only. Others must document and coordinate their changes with the responsible designer or professional. We are not responsible for changes made without our involvement.

Portal access is included for 60 days after delivery of your complete final plan package. Please download and save your files during this period. We will send reminders approximately 30 days and 7 days before included access ends. Access will be extended as needed to resolve outstanding delivery or file-access problems.

Any optional annual membership will have its price, benefits, and renewal terms presented separately before purchase. Purchasing design services does not enroll you in a membership or authorize membership charges. Membership is not required to keep or use your downloaded plans.

13 Corrections and limits of liability

Designscape provides the creative landscape design services identified in the agreed order. Designscape does not perform, supervise, or control construction, installation methods, jobsite safety, or contractor workmanship.

If a Designscape deliverable contains an error within the agreed design scope, Designscape will have a reasonable opportunity to correct the affected plans without an additional design fee. To the fullest extent permitted by applicable law, correction of the affected plans is the customer’s exclusive remedy for that error, and Designscape excludes liability for resulting construction costs, delays, loss of use, and other project-related monetary damages.

These limitations do not exclude liabilities or remedies that applicable law does not permit the parties to exclude.

14 Concerns and legal rights

Please contact Designscape promptly through the portal or support email with any concern, identifying the project, the issue, and your requested resolution. This gives us an opportunity to investigate, respond, and correct problems within the agreed scope. We will make a good-faith effort to resolve the concern informally within 30 calendar days after receiving it. If the concern remains unresolved, the parties may agree in writing to mediation, including the mediator and allocation of mediation costs. Mediation is voluntary; this agreement does not require arbitration. Informal discussion or mediation does not prevent either party from seeking urgent relief, meeting a legal deadline, or pursuing a claim in small-claims court where eligible or another court with jurisdiction. Nothing in this section restricts contacting regulators or waives class actions, jury rights, or nonwaivable consumer protections.

If a provision is unenforceable, the remaining provisions continue only to the extent permitted by law. This agreement does not waive liability or rights that cannot lawfully be waived.

15 Acceptance and records

Before payment, you will be able to read, download, and save this agreement and the itemized order. To proceed to payment, you must actively select the unchecked agreement box. Your selection records your electronic acceptance of the displayed agreement version and order. Designscape manifests its assent by offering these terms through its authorized checkout and issuing the order confirmation after successful payment. No separate handwritten signature or manual Designscape countersignature is required unless applicable law requires otherwise. A copy of the accepted agreement and order will be provided to you. Any legally required consent to electronic records will be obtained separately where necessary.

Checkout acknowledgment: “I have read and agree to the Designscape Landscape Design Service Agreement and the itemized project scope and price shown above. By checking this box and completing payment, I enter into this agreement electronically. I understand that construction and installation are separate services.”

The electronic acceptance record identifies the customer and order, agreement version, acceptance time, and payment reference. Acceptance is tied to the exact agreement and itemized scope presented before payment; later changes do not overwrite that record.
